Agreement to Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you and That Sermon (“ThatSermon,” “we,” “us,” or “our”) regarding your use of the ThatSermon spiritual growth application (the “Service”).
By using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, do not use the Service.
Service Description and Limitations
What the Service Provides
The Service offers:
- Audio recording of sermons and talks
- On-device transcription using Apple’s Speech framework (audio never leaves your device)
- Theme and topic identification
- Bible reference extraction and linking
- Sermon summaries and insights
- Connecting sermons, themes, and scriptures across your journey
- Search across your sermon history
- Family discussion guides
- Small group sharing features
AI-Generated Content Disclaimer
THE SERVICE USES ARTIFICIAL INTELLIGENCE TO TRANSCRIBE AUDIO AND GENERATE ANALYSIS. AI-GENERATED CONTENT MAY BE INCOMPLETE, INACCURATE, OR INCORRECT.
- Verify transcriptions for important quotes or Bible references
- Cross-check themes with your own notes and understanding
- Confirm scripture references against actual Bible text
- Do not rely solely on AI analysis for theological understanding
The Service is provided for personal growth and convenience purposes only. It does not:
- Replace your personal Bible study and prayer
- Substitute for pastoral guidance or theological training
- Serve as an authoritative source of doctrine
- Guarantee perfect transcription accuracy
- Interpret scripture with denominational specificity
You remain solely responsible for:
- Your own spiritual growth and discernment
- Verifying AI-generated content
- Confirming Bible references and theological concepts
- Making personal decisions about faith and practice
Transcription Accuracy
TRANSCRIPTION ACCURACY DEPENDS ON AUDIO QUALITY.
Transcription may be inaccurate if:
- Audio quality is poor
- Background noise is present
- Multiple speakers talk simultaneously
- The speaker has a strong accent
- Technical terms or names are used
- The microphone is far from the speaker
The Service cannot guarantee perfect transcription. Always verify important quotes, Bible references, and theological concepts.
Service Limitations
The Service does NOT:
- Provide theological training or pastoral counseling
- Replace personal Bible study and spiritual disciplines
- Guarantee interpretation aligned with your denomination
- Serve as an official church record of sermons
- Provide real-time transcription during live recording
- Support all languages (currently English only)
Church Copyright and Recording Policy
Respecting Church Rights
Churches own the copyright to sermons preached by their pastors and staff.
By using the Service to record sermons, you represent that:
- You have permission to record (explicitly or through church policy)
- The church has not opted out of our service
- You will use recordings for personal, non-commercial purposes only
- You will not redistribute recordings without church permission
Church Opt-Out
Some churches have opted out of our service and do not permit recording.
Before recording:
- Check if your church has opted out (available in app settings)
- Respect church policies regarding recording
- Obtain permission if you’re unsure
If you record at an opted-out church:
- We may delete the recording upon notification
- We may suspend your account for repeated violations
- You may face consequences from the church
Fair Use and Personal Use
Your recordings are intended for:
- Personal spiritual growth and study
- Small group discussion (with appropriate permissions)
- Family devotions and teaching
- Private reflection and note-taking
Prohibited uses:
- Redistributing sermons publicly without permission
- Commercial use or sale of recordings
- Creating derivative works for public distribution
- Posting on social media or public platforms without church consent
Eligibility
To use the Service, you must:
- Be at least 13 years of age (users 13-17 require parental consent)
- Be legally capable of entering into binding contracts
- Provide accurate and complete registration information
- Comply with all applicable laws and church policies
If you are using the Service on behalf of an organization (church, small group, ministry), you represent that you have authority to bind that organization to these Terms.
Account Registration and Security
Creating an Account
When you sign up, you provide:
- Email address (required)
- Full name
- Profile information (optional)
- Church affiliation (optional)
Account Responsibilities
You are responsible for:
- Maintaining the security of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
- Ensuring your contact information is current
Account Suspension or Termination
We reserve the right to suspend or terminate your account if:
- You violate these Terms or our Acceptable Use Policy
- You provide false or misleading information
- You engage in abusive or fraudulent behavior
- Payment obligations are not met
- You repeatedly record at opted-out churches
We may suspend access immediately without prior notice if:
- Required by law or court order
- Necessary to prevent ongoing harm or liability
- Your account shows signs of unauthorized access
- We detect fraudulent or abusive activity
- You upload content that violates intellectual property rights
Acceptable Use Policy
Permitted Uses
You agree to use the Service:
- For personal spiritual growth and education
- In compliance with all applicable laws
- In a manner that respects church copyright
- Respectfully and professionally
- With accurate information
Prohibited Activities
General Prohibitions - You may NOT:
- Use the Service for any illegal purpose
- Violate intellectual property rights of churches or third parties
- Share your account credentials with unauthorized persons
- Impersonate another person or organization
- Misrepresent your identity or authority
System Abuse - You may NOT:
- Attempt to gain unauthorized access to the Service
- Probe, scan, or test system vulnerabilities
- Breach or circumvent security measures
- Interfere with or disrupt Service operation
- Introduce viruses, malware, or harmful code
- Use automated systems (bots, scrapers) to access the Service
- Reverse engineer or decompile the Service
- Overload or spam the Service
Content Violations - You may NOT:
- Upload copyrighted material without authorization
- Record sermons at churches that have opted out
- Share recordings publicly without church permission
- Upload false, fraudulent, or fabricated content
- Upload pornographic, obscene, or inappropriate content
- Upload content that promotes hate, violence, or discrimination
Recording Violations - You may NOT:
- Record in churches that prohibit recording
- Secretly record private conversations
- Use recordings for commercial purposes without permission
- Redistribute recordings without authorization
- Edit recordings to misrepresent the speaker’s message
Prohibited Sensitive Information
THE SERVICE IS NOT DESIGNED TO STORE SENSITIVE PERSONAL INFORMATION.
You may NOT upload or transmit:
- Protected Health Information (PHI) under HIPAA
- Children’s Personal Information under COPPA (for children under 13)
- Financial Account Information under GLBA
- Government Identification Numbers (Social Security Numbers, passport numbers)
- Special Categories of Data under GDPR Article 9(1) (genetic data, biometric data for identification)
Permitted Information: You MAY store:
- Sermon notes and personal reflections
- Bible study materials
- Church service information
- Small group discussion content
- Family devotional notes
Enforcement
Violations may result in:
- Warning and request to cease prohibited activity
- Temporary suspension
- Permanent termination
- Deletion of violating content
- Reporting to law enforcement or churches
- Legal action to recover damages
Intellectual Property Rights
Service Content
The Service, including its software, design, algorithms, and all intellectual property rights therein, is owned by ThatSermon or its licensors and is protected by copyright and trademark laws.
Your Content
You retain ownership of content you create (recordings, notes, reflections). By using the Service, you grant ThatSermon a worldwide, non-exclusive, royalty-free license to:
- Store and process your content to provide the Service
- Use anonymized, aggregated data to improve transcription and analysis
- Backup and archive your content for Service operation
We will never:
- Share your sermon recordings with third parties without consent
- Use your recordings for purposes other than providing the Service
- Claim ownership of your personal content
Church and Pastor Copyright
Sermons are typically owned by the church or pastor who delivered them. Recording and storing sermons for personal use generally falls under fair use, but:
- You do not own the copyright to sermon recordings
- Churches retain rights to their sermons
- We respect church opt-out requests
- Redistribution may require church permission
Third-Party Content
The Service may include:
- Bible text from licensed or public domain sources
- Theological reference materials
- Church information from public databases
Third-party content is subject to the intellectual property rights of its respective owners.
Payment Terms
Free Trial
New users receive a 14-day free trial. After the trial:
- Basic features may have limitations
- Full features require a paid subscription
Subscription Plans
Subscriptions are billed:
- Monthly ($14/month) or annually ($140/year)
- Automatically renewing unless cancelled
- At the rate disclosed at time of purchase
Payment Processing
Payments are processed by Stripe. By subscribing, you authorize:
- Automatic charges to your payment method
- Storage of payment information by Stripe (not by us)
- Price increases with at least 30 days notice
Cancellation and Refunds
You may cancel your subscription at any time:
- Cancellation takes effect at the end of the current billing period
- No refunds for partial periods
- Access to premium features ends at subscription expiration
- Your data is retained per our Privacy Policy
Price Changes
We may change subscription prices with 30 days notice. Continued use after price changes constitutes acceptance.
Service Availability and Modifications
No Uptime Guarantee
We strive for high availability but do not guarantee uninterrupted access. The Service may be unavailable due to:
- Scheduled maintenance
- Technical difficulties
- Third-party service outages
- Force majeure events
Service Modifications
We reserve the right to:
- Modify or discontinue features
- Change functionality or interface
- Update system requirements
- Implement usage limits
We are not liable for any modification, suspension, or discontinuation of the Service.
Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, INCLUDING:
- Warranties of merchantability or fitness for a particular purpose
- That the Service will be error-free, secure, or uninterrupted
- That transcriptions will be accurate or complete
- That AI-generated content will be correct or theologically sound
LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
THATSERMON, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, consequential, or punitive damages
- Lost profits, data, or opportunities
- Reliance on AI-generated transcriptions or analysis
- Service interruptions or data loss
- Theological misunderstandings arising from AI analysis
- Copyright violations by users
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
Content Disclaimers
THATSERMON IS NOT RESPONSIBLE FOR:
- Accuracy of transcriptions
- Theological interpretation of sermons
- Copyright compliance of user recordings
- Church policies or disputes
- Lost recordings due to technical issues
- Misunderstandings arising from AI analysis
Indemnification
You agree to indemnify, defend, and hold harmless ThatSermon from claims, damages, and expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Recording violations or copyright infringement
- Inaccurate information you provide
- Church policy violations
- Third-party claims related to your use
EXCEPT for claims arising SOLELY from:
- ThatSermon’s gross negligence or willful misconduct
- ThatSermon’s violation of applicable law
- ThatSermon’s material breach of these Terms
Third-Party Services
The Service integrates with third-party services:
- Apple (in-app purchase processing and subscription billing)
- xAI (Grok) (sermon transcript analysis — summaries, themes, action items)
- Bible APIs (scripture text)
Note: Sermon transcription is performed entirely on your device using Apple’s Speech framework. No audio is sent to any third party.
We are not responsible for:
- Third-party service availability
- Third-party data accuracy
- Third-party terms or pricing changes
Data and Privacy
Your use is subject to our Privacy Policy, incorporated by reference.

Termination
Termination by You

Effect of Termination
Upon termination:
- Access ends immediately
- We may delete your data per our retention policy
- Payment obligations survive
- Liability limitations and indemnification survive
Dispute Resolution
Governing Law
These Terms are governed by Delaware law, without regard to conflict of law provisions.
Arbitration Agreement
PLEASE READ CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Disputes shall be resolved by binding arbitration, except:
- Small claims court disputes (under $10,000)
- Intellectual property disputes
- Emergency injunctive relief
Opt-Out Right:
New users may opt out within thirty (30) days by:
- Emailing legal@thatsermon.com with your name and email
- Stating: “I opt out of the Arbitration Agreement”
Arbitration Terms:
- Administered by American Arbitration Association (AAA)
- AAA Commercial Arbitration Rules apply
- One arbitrator
- Location: Boise, Idaho, or remote by video
- Decision is final and binding
Arbitration Costs:
- Each party bears their own attorney’s fees unless arbitrator awards otherwise
- For individual disputes under $75,000: ThatSermon pays AAA fees exceeding small claims court fees
Class Action Waiver
YOU AGREE TO RESOLVE DISPUTES INDIVIDUALLY, NOT AS PART OF A CLASS ACTION.
Miscellaneous
Entire Agreement
These Terms and our Privacy Policy constitute the entire agreement.
Modifications
We may modify these Terms with notice via email. Continued use constitutes acceptance.
Severability
If any provision is invalid, the remaining provisions remain in effect.
No Waiver
Our failure to enforce any provision does not waive our right to enforce it later.
Assignment
You may not assign these Terms. We may assign to any successor or affiliate.
Force Majeure
We are not liable for delays due to circumstances beyond our reasonable control.
